Chapter 13 Bankruptcy is a legal process that occurs when people file a petition with a U.S. bankruptcy court.  Once the petition is filed and the process is complete, people will be able to repay their creditors over a time period of 3 to 5 years.  This gives people a chance to manage and then reduce their debts over the course of time.

Chapter 13 Eligibility

Not everyone is eligible for Chapter 13 Bankruptcy.  In order to file for this type of bankruptcy, people must meet eligibility requirements.  To file for Chapter 13, people must:  meet the residency requirements of their state (reside in their state for at least 90 days prior to filing), not have filed for bankruptcy in the past 8 years, not have a bankruptcy case dismissed 6 months prior to filing, complete credit counseling 6 months prior to filing, pass the means test.  Finally, people must prove that they have sufficient income to repay their creditors.  They must also have no more than $250,000 in unsecured debt and no more than $750,000 in secured debt.
